I knew past <br /> Eugene Parks Directors Tex Bratzler and Mel Jackson. Mel and I canoed together sometimes <br /> in the old days. During my 26 years in the Oregon Legislature I represented Eugene <br /> downtown, among other areas. <br /> As a part of that legislative service I passed, over the objection of the then President of the <br /> Senate, a Bill appropriating $100,000 to help the City acquire the Wayne Morse property which <br /> was stated to be held by the City "in Trust for the people." <br /> I am aware that there were also federal funds involved and have viewed the minutes of the <br /> Eugene Council's initial decision to buy the Morse property, a quarter of a century or more ago. <br /> The minutes recited the source of funds as state, federal, and some City Bond issue funds. It <br /> did not recite any restrictions on the Morse Park land. That leads me to the purpose of this <br /> letter which is a request for information. <br /> Is there a written limitation or positive declaration that is contained in documents of the funding <br /> sources that provided the funds used to acquire the property way back then concerning (1) the <br /> name of the Morse Park or, (2), the subject of the activity there? To state that inquiry <br /> differently, please provide any restrictions on use, or positive declarations in the documents of <br /> the funding sources at the time the City received and spent the funds to acquire the Morse <br /> Park. Also, are any declarations or limits in Mrs. Morse's deed to the City. If there are no <br /> restrictions other than "in Trust for the people," please state that fact. Photocopies of what the <br /> funding sources wrote would work fine if there are written restrictions or declarations in them. <br /> If there is a written opinion by a City Attorney advising the City about park use that is based on <br /> the requirements of the funding sources, or Mrs. Morse's deed please include that in your <br /> response. <br /> The written information requested, if there is any such, will provide valuable information. No <br /> hurry. A month from now would be fine. I will share your response with written documents with <br /> the Morse archivist, who provided me the Council minutes to which I have referred and, as <br /> appropriate, with the Board at no additional expense to your department or the City. <br /> Sincerely. <br /> P "'roc <br /> Edward N.
