Medlin <br /> Director, Parks and Open Space Division <br /> 1 1820 Roosevelt Blvd. <br /> Eugene, OR 97402 <br /> Dear Mr. Medlin; <br /> In response to your letter dated September 24, 2004. <br /> I did not misunderstand my attorney or the city when they told me they would condemn <br /> the property in order to obtain this piece of land. Here is an excerpt of a letter that our <br /> attorney wrote Russ Royer on June 28, 2001. <br /> At the outset, I wish to emphasize that MR and Mrs. Ogren are strongly opposed to the <br /> proposed taking of approximately 4.42 acres out of the their approximately 7.2 acres of <br /> property for park purposes. Mr. and Mrs. Ogren have owned this property in excess of 20 <br /> years, and have invested substantial effort and financial resources in developing it as <br /> both a homestead and nursery. Their clear preference would be for the City to explore all <br /> available alternatives prior to pursuing a taking of their property. <br /> This letter was sent after our attorney was in contact with the City and found that they <br /> were going to pursue condemnation should we decide not to sell. We felt we were forced <br /> at that point to deal with the City. <br /> I am sure that you have standards for the care of a"park", but I do not believe that <br /> includes allowing litter, 5 foot thistles, and weeds that have not been mowed at all. The <br /> large open area has been rough mowed but not the area with trees. I can only assume that <br /> you have not even looked at this property or you would not state that you have met these <br /> obligations.
