While the City has the authority to condemn property, we have very little history of that <br /> happening for acquisition of park property. We have not used condemnation for any <br /> park property in at least 15 years and I do not believe we would have done so here. <br /> Perhaps your attorney may have explained to you the City could condemn if determined <br /> necessary or the potential tax advantages to you if we were to do so, but we never <br /> determined to condemn your property and it would have required City Council action <br /> before doing so. <br /> I hope the above has been helpful in providing information regarding some of your <br /> issues of concern. <br /> Sincerely, <br /> � <br /> Johnny R.
