Located outside the city limits, the parcel lies inside the Urban <br /> NIN6rowth Boundary. Despite the absence of an agreement addressing tree protection between Eugene and Lane County <br /> since 1996, the City Attorney has determined the City has jurisdiction for these requirements in the urban transition area. <br /> Dozens of trees, perhaps more than 100, have been cut down. Staff have documented evidence of the cutting and are <br /> analyzing what enforcement action may be warranted. <br /> Before significant tree-cutting began, the City provided information about the Lane Code requirements to a contractor <br /> working at the site. It appears the contractor and property owner removed trees exceeding the standards. Because of <br /> confusion over authority for tree protection, neither the County nor City enabled the contractor to apply for a tree removal <br /> permit. Neighbors of the site have expressed concerns about the impacts of tree removal and other work. No fill permit is <br /> required, there is no wetlands violation, and although there is currently no apparent violation, the City lacks authority to <br /> require an erosion prevention permit because the parcel is outside the City. Future development would be regulated <br /> through annexation to Eugene, as well as zoning and other requirements. Staff has used mail-out surveys, drop-in displays <br /> and forums, design charrettes, to name a few. Most recently, great strides have been made in promoting the use of the <br /> Internet. The Internet is an excellent way to provide detailed, up-to-date information on parks, planning efforts, volunteer <br /> projects and much more in a readily-available format, 24-hours a day to anyone in the community or around the world. <br /> In the month of January alone, more than 3,500"page views"were recorded on Parks and Open Space web sites.
