LAND USE AGREEMENT <br /> --a <br /> L. <br /> THIS AGREEMENT, made and entered into by an between the STATE OF <br /> OREGON, by and through its State Highway Commission, hereinafter called "State," ,^,'1 <br /> and the CITY OF EUGENE, a municipal corporation of the State of Oregon, by and v <br /> through its City Officials, hereinafter called "City "; RECEIVED <br /> w <br /> W I T N E S S E T H: JUN w 2 1973 <br /> RECITALS: -EUGENE R/W <br /> WHEREAS, State is the owner of a certain parcel of real property located <br /> at the intersection of Coburg Road and Country Club Road, lying within the <br /> corporate limits of the City of Eugene; and <br /> • WHEREAS, City desires to use said parcel of real property for develop- <br /> ment of a landscaped area to enhance the esthetics surrounding this entrance to <br /> the City;' and <br /> WHEREAS, State is agreeable to such use and has, <br /> by the authority in <br /> ORS 366.395, determined that said parcel will not be reeded, required or useful <br /> for highway purposes during the period of this agreement; and . <br /> • <br /> WHEREAS, attached hereto, marked Exhibit A, and by this reference made <br /> a past hereof, is a sketch map showing the approximate location and limi -ts of <br /> said parcel of real property. • <br /> NOW, THEREFORE, the premises being in general as stated in the foregoing <br /> RECITALS, it is agreed by and between the parties hereto as follows: <br /> 1.
