Section 5. Section 7.990 of the Eugene Code, 1971, is hereby amended, and a new <br /> Section 7.995 added thereto, to provide: <br /> 7.990 Penalties - [Speeifie] General. Violation of any section in this chapter is <br /> punishable by fine not to exceed $500.00. <br /> 7.995 Penalties - Specific. <br /> (1) Violation of section 7.665 to and including section 7.670`: is, punishable <br /> by a fine of a minimum of $100.00 to a maximum of $4,000.000 for each tree removed, or <br /> confiinementin jail not to,, exceed" 100=days, or both fine and= imprisonment. In addition, the <br /> city attorney, upon =: request of the city manager, shall institute, any necessary legal <br /> Proceedings to enforce the provisions of sections 7.665 and,;., 7.670 oflhis code. <br /> (2) In addition to any penalty that maybe imposed under subsection t <br /> of this section,- theecourt may require a person, who wilfully violates subsection 7.665(2) to <br /> pay-to the city a sum equalto the value of the felled heritage tree;-which shall be calculated <br /> using themethods "set forth in the edition then in :effect of the Guide for Plant Appraisal <br /> Publishe& by the International Society of Arboriculture Council of Tree Landscape <br /> Appraisers. <br /> Section 6.
