q I - I I P9 Yel ;j Z/1 64( --c/ <br />y <br />Court sa s cities liable for vegetation <br />By The Associated Press <br />SALEM — Cities can't shield them- <br />selves from liability for overgrown <br />veetation along streets by delegating <br />that duty to landowners, the Oregon <br />Court of Appeals ruled Wednesday. <br />. In a case involving the City of Port- <br />land, the court said a state law making <br />governments liable for such damages <br />supersedes city ordinances. <br />The court said the duty to control <br />vegetation along streets doesn't come <br />under the law's exemption from liabili- <br />ty for discretionary acts. <br />The ruling returns the case to the <br />lower court for further proceedings. <br />
