In a case involving the City of Port- <br />land, the court said a state law making <br />governments liable for such damages <br />supersedes city ordinances. <br />The court said the duty to control <br />vegetation along streets doesn't come <br />under the law's exemption from liabili- <br />ty for discretionary acts. <br />The ruling returns the case to the <br />lower court for further proceedings. <br />
