Trees and Foliage in Right -Of -Way <br />7.635 Foliage - Permit to Plant <br />(1) No person shall plant, or allow to be planted in a public <br />right -of -way, pedestrian right -of -way, or pedestrian easement, a tree, <br />shrub, or plant without obtaining a permit at least ten days prior thereto. <br />(2) The city manager, or the manager's designee, shall approve <br />the type, location, spacing, and number of trees, shrubs or plants prior to <br />issuance of the permit. <br />7.635 <br />Eugene Code <br />7.990 <br />(3) A permit shall not be required hereunder for the planting <br />of any flowering or fruit bearing plant, other than a tree, that does not <br />violate the requirements of subsections 6.010(1) and (j) of this code. <br />(Section 7.635 amended by Ordinance No. 19146, enacted May 25, 1983, and <br />Ordinance No. 19393, enacted July 28, 1986.) <br />7.640 Foliage - Certain Trees Prohibited No person shall plant, <br />or cause to be planted, a balm, poplar, nut, locust, fruit, <br />cottonwood, willow or a cone or needle bearing tree within the right -of -way <br />of a street, avenue, highway or alley, pedestrian right -of -way or pedestrian <br />easement, within the city. <br />7.650 Foliage - Trimming, Pruning or Removal All trees, shrubs, plants <br />and vegetation growing within or projecting into the right -of -way <br />of a street, avenue, highway, alley, pedestrian right -of -way or pedestrian <br />easement, may be trimmed, pruned or removed at any time by the city, or the <br />city may require the person responsible to abate any existing nuisance under <br />chapter 6 of this code. <br />(Section 7.650 amended by Ordinance No. 19393, enacted July 28, 1986, <br />effective January 28, 1987.) <br />Penalties <br />7.990 Penalties - Specific Violation of any section in this chapter <br />is punishable by fine not to exceed $500.00. <br />(Section 7.990 amended by Ordinance No. 19393, enacted July 28, 1986, <br />effective January 28, 1987.) <br />
