1 <br />VEGETATION RELATED ORDINANCES cit of Eu Code <br />excerpts <br />4.832 Public Ways - Obstructing Vegetation Prohibited No owner or person <br />in charge of property shall allow vegetation on his or her property or on the public way <br />abutting his or her property to become a nuisance as defined in section 6.010 of this code. <br />4.833 Foliage - Obstruct Vision at Intersection No owner or person in <br />charge of property shall plant, maintain or allow vegetation which is higher than 18 <br />inches above the crown of the adjacent roadway in that portion of the right -of -way between the property <br />line and the curb line within 35 feet from the intersection of curb lines, if extended, at any street, avenue <br />or highway intersection. This provision shall also apply within 15 feet of the intersection of an alley <br />with a street, avenue or highway right -of -way. Where curbs do not exist, no such use of right -of -way <br />shall be made within 25 feet of the intersection of property lines if extended at the street, avenue, or <br />highway intersection. <br />4.835 Depositing Materials in Streets <br />(1) No person shall throw, place, deposit, scatter or drop gravel, rubbish, earth, <br />asphalt or lumber on a paved street or alley unless deposited in one pile for immediate use; provided, that <br />no such materials shall obstruct the flow of water through a ditch, drain or gutter. <br />(2) A person violating this section shall remove all such materials from the <br />pavement, and in case of failure to do so on demand from the city manager or his designate, the city may <br />clean the paved street of such materials and charge expense to said person. <br />Chapter 6 <br />Nuisances <br />6.005 Definitions For purposes of sections 6.005 to 6.845, the following <br />words and phrases mean: <br />Developed property A tract of land occupied preponderantly by a structure used <br />or designed for use as a residence or a place of economic enterprise, by landscaping, by <br />other improvement accessory to the structure, or by a combination of such land <br />development. <br />Enforcing officer Any city employee authorized by the city manager to enforce <br />the nuisance abatement provisions of this chapter. <br />Person in charge of property An agent, occupant, lessee, tenant, contract <br />purchaser, or other person having possession or control of property or the supervision of <br />a construction project on the property. <br />Person responsible Any or all of the following: <br />(a) The owner of the property on which the nuisance exists or the <br />owner of property which abuts a public way where a nuisance exists. <br />(b) The person in charge of the property or of property which abuts <br />
