Sneddon Estate <br /> Richard and Julie Noll <br /> 3393 Harlow Rd <br /> Eugene, Or 97401 <br /> • <br /> Subject: Protest of Billing for Abatement <br /> Tax Lot # 17- 03 -21 -34 -04100 <br /> Invoice # 95 -68 <br /> Dear Richard and Julie Noll: <br /> We are in receipt of your letter to the City of Eugene Finance Department protesting billing for abatement of a <br /> hazardous tree from the above referenced property. This letter is written in response to your protest and will attempt <br /> to address the specific concerns expressed in your letter. <br /> Your letter of protest stated that the hazardous tree was located on City property and was in danger of falling onto a <br /> bus stop. We have determined that the tree was not located on City property. The tree was located on tax lot 17 -03- <br /> 21 -34- 04100. The tree, a nuisance per code 6.010 (I) 2, was extremely hazardous to pedestrians using the sidewalk, <br /> vehicles using Harlow Road, and people waiting at the bus stop. Municipal code ,4.832, states that it is the <br /> responsibility of the owner of the property to abate a hazard or nuisance tree. As the owner of the parcel on which the <br /> hazardous tree was located, you are responsible for the removal of this hazardous tree. You were sent notices to this <br /> effect on May 27, 1995 and again on August 1, 1995. You failed to abate the hazard and the city had no choice but <br /> to abate the hazard as required by code. <br /> For reasons stated above, your protest of the billing for abatement is denied. The total of the invoice for abatement in <br /> the amount of $782.50 is due and payable within ten days of this determination. I understand that you may find this <br /> denial of your protest disappointing. I hope that you understand that the City must establish and follow codes and <br /> policies which provide for the safety and protection of the community and equal treatment of property owners.
