Box 14480
Salem, OR 97309 -0405
RE: OPTIONAL REPORT NUMBER M1454- 025 -06
Dear Mr. Wood:
The City of Eugene wishes to appeal Citation 1 Item 1(b) contained in the above listed
Optional Report Number. The citation was received by mail delivery at the City of
Eugene Human Resource Risk Management Office on May 10, 2006. The City of
Eugene requests that an informal conference be scheduled to resolve this item.
At issue is the inspector's interpretation that the supervisor of the victim allowed this
employee to set her own work hours without any direct supervision while working on the
fish trap. The injured employee is a paraprofessional and her normal job duties as a
Habitat Enhancement Coordinator include participating with multi- agency personnel to
plan, coordinate and implement natural resource and habitat improvement projects. The
person in this position is expected to work independently with little supervision and to
work flexible hours including on weekends.
As a point of clarification, Citation 1 Item 1(c) refers to City of Eugene employees with
little or no experience being allowed to work from the fish trap. These employees were
given a safety orientation and basic training in the work they were performing by the OR
Fish & Wildlife Fish Biologist who was supervising the work for the joint project.
Please contact me if you have any questions.
Sin y
Mike Pungercar, CSHM
Safety /Loss Control & Environmental Program Manager
City of Eugene
Human Resource & Risk Services
777 Pearl Street - Room 101
Eugene, OR 97401
(541) 682 -5762
mike.f.pungercar @ci.eugene.or.us '
cc: Johnny Medlin — Parks & Open Space Director
This paper is made of 100% post- consumer recycled fiber.
