Examples being discussed <br /> include banning truck traffic from West 18th Avenue and not allowing trucks to <br /> operate during peak traffic periods. <br /> Street Vacation <br /> Fill and Grade Permit <br /> District Court Lawsuit <br /> There have been two legal actions taken in U.S. District Court in Portland that <br /> significantly impact the City of Eugene's West Eugene Wetlands program. The <br /> first suit was filed on December 12. The City of Eugene received a copy of the <br /> suit on Monday. The second lawsuit was filed late Thursday afternoon. The City <br /> has not received a copy of this filing yet. <br /> These suits seek to invalidate the West Eugene Wetlands Plan by suspending all <br /> Federal actions taken which rely entirely or partially on the Plan. These legal <br /> actions are of great concern to the City of Eugene because they call into question <br /> the years of planning and policy development work that has gone into creating the <br /> West Eugene Wetlands Plan. In addition, the legal actions may jeopardize public <br /> and private restoration and development projects that are pending in west <br /> Eugene. <br /> The City Attorney's Office has not had adequate time to fully analyze the effects <br /> of either suit. However, it appears at this point that these suits could prevent the <br /> City from moving forward on projects such as the Amazon Canal restoration. <br /> Due to the significant implications of these legal actions, the City has asked the <br /> City Attorney's Office to intervene in these matters. <br /> Both of these suits will be hear in Eugene. Judge Michael Hogan has set January <br /> 19, 1996 to hear arguments on the merits of the cases. <br /> Temporary Restraining Order <br /> Both sets of plaintiffs who filed lawsuits also filed motions for temporary <br /> restraining orders to prevent any construction activity on the Hyundai site. Judge <br /> Hogan dismissed both of those motions late Friday morning. <br />
