1 <br /> t -- <br /> A A. ; <br /> M E M O R A N D U M <br /> December 22, 1995 <br /> TO: Mayor and City Council <br /> FROM: Linda Norris, Deputy City Manager <br /> SUBJECT: UPDATE ON RECENT ACTIVITIES REGARDING HYUNDAI <br /> Two days ago, the U.S. Army Corps of Engineers approved Hyundai Electronics <br /> America's request for a wetland's fill permit. In the intervening 48 hours, a <br /> number of things have occurred. Hyundai applied for a variance to the City's <br /> noise ordinance to allow construction activity 24 -hours a day. The company is <br /> also expected to file for a permit to remove 3 trees from the construction site. <br /> Yesterday, the D.A.G. Trust paid the City approximately $39,000 to complete the <br /> vacation of West 18th Avenue. Later in the day, the City issued a fill and grade <br /> permit to the Trust. <br /> Several legal actions were taken yesterday, as well. Two sets of plaintiffs went to <br /> court seeking temporary restraining orders to prevent construction activity. The <br /> first restraining order was requested as part of a lawsuit filed in U.S. District <br /> Court several days ago. City staff received a copy of this suit on Monday and are <br /> still reviewing it. The second request for a restraining order came as the result <br /> of a lawsuit filed late on Thursday. <br /> A hearing on these two temporary restraining orders was held this morning at <br /> 9:30 a.m. Both motions were denied. <br /> Once the question of restraining orders was resolved, brush clearing and other <br /> preliminary work began on the Hyundai site. Th ughout the day a }handful of <br /> protesters were present near the Hyundai site. Several people `themselves <br /> to pieces of heavy equipment with a U- locks. Eugene police were called out and <br /> the people were arrested once the locks were removed. <br /> Tree Removal Permit <br /> Hyundai is expected to file an application for a tree removal permit sometime <br />
