Thanks Kurt for incorporating this so that Dennis can pass on a more <br /> complete update for the Council. <br /> Ansen Berg applied for and received a house move permit to move the house to an R -1, Low <br /> Density Residential, lot at 1565 Jefferson Alley in 11/02. During review of the foundation <br /> permit application, Mr. Berg learned that although the resident of the previous dwelling <br /> accessed the property from the City Parks property to the west, this was not a legal <br /> access to the site. In addition, he discovered that an adjoining neighbor's sewer line <br /> runs through the middle of his lot. Staff identified these and other issues and provided <br /> options for how he might resolve them. During the next several months staff contacted Mr. <br /> Berg to encourage him to resolve these issues. <br /> In August of 2003, Land Use staff received a complaint about the house being stored on the <br /> lot. Since Mr. Berg had not yet resolved his issues with the foundation permit an order <br /> to correct notice was sent. The property was fenced, house boarded up and signage placed <br /> at the site to comply with the house move permit conditions of approval. In addition, a <br /> short deadline was established to submit an application of a temporary surfacing permit to <br /> Public Works and resolve all other issues so that the foundation permit could be issued. <br /> Mr. Berg contacted staff soon after and explained that he was discussoing with Parks and <br /> Open Space staff to gain access to the site from parks property. His foundation permit <br /> expired in November 2003. <br /> In August, 2004 another complaint was received. An order to correct notice was sent. In <br /> response to the order to correct notice Mr. Berg applied for a new foundation permit in <br /> 9/04, since the previous application had expired. <br /> Shortly after the notice was sent, Mr. Berg attended a Jefferson /Westside neighborhood <br /> association meeting where the City Manager was scheduled to speak. With the support of the <br /> neighborhood group, Mr. Berg requested at the meeting additional assistance to resolve his <br /> legal access issues. Soon after, Johnny Medlin contacted Mr. Berg to learn more about the <br /> situation and identify options. Civil penalties were not issued since the new discussions <br /> with Public Works staff were taking place. <br /> (Johnny's e-mail takes it from here.
