Mike Gleason <br /> July 27, 1994 <br /> Page 3 <br /> (c) If a nonconforming structure is moved, it must then conform to the <br /> regulations of the district in which it is located after it is moved. <br /> (d) On any nonconforming structure or portion of a structure containing a <br /> nonconforming use, ordinary repair is permitted if, in any 12 month period, the <br /> work does not exceed 50 percent of the current replacement cost of the <br /> nonconforming structure or portion of the nonconforming structure, as the case <br /> may be." (Emphasis supplied). <br /> The fact that the structure is no longer permitted in the district has nothing to do with the height, <br /> solar setback, yard, coverage, or area requirements of the district or with any requirements <br /> imposed by the Eugene Code. The structure is no longer permitted because it is inconsistent <br /> with the Master Plan. Because a source other than the provisions of the code prohibits the <br /> structure, it is not a nonconforming structure under the code. Although the structure would be <br /> used to facilitate a use permitted in the Woodland zone, it is not permitted under the current <br /> Plan. <br /> The Plan does not contemplate a structure for nature study in the Woodland zone. <br /> Neither does the Plan contemplate such a structure in the Meadows zone, where the other <br /> existing residential structures appear to be located. Those subzones are designed to preserve <br /> open space and natural habitat. If the drafters of the Plan had intended to allow for structures <br /> incidental to the permitted uses in the Natural Areas and Open Space zones, they could have <br /> provided for them. They did not The Cultural Resources zone is the zone designed for the sort <br /> of development and activity proposed by Nearby Nature. <br /> IV. Amendment of the Alton Baker Park Master Plan <br /> The City Council may, by motion, initiate an amendment to the Alton Baker Park Master <br /> Plan. EC 9.139_ If the City Council chooses to initiate an amendment, a public hearing will <br /> be held before the planning commission to consider the proposed amendment. The amendment <br /> must satisfy the following applicable approval criteria: <br /> (a) The Plan amendment is consistent with the Metro Plan <br /> (b) The Plan amendment is consistent with the remaining portions of the Alton Baker <br /> Park Master Plan. <br /> (c) The Plan amendment is found to address one or more of the following: <br /> 1 _ An error in the publication of the Plan. <br />
