CITY OF EUGENE <br /> INTER - DEPARTMENTAL MEMORANDUM <br /> CITY ATTORNEY - CIVIL DEPARTMENT <br /> To: Mike Gleason Date: July 27, 1994 <br /> City Manager <br /> Subject: Relocation of Nearby Nature into Existing Structure in Alton Baker Park <br /> You ask whether the Alton Baker Park Master Plan would allow the Southernmost <br /> existing residential structures in the park to be used for Nearby Nature.. Nature study is a <br /> permitted use in the Alton Baker Park Master Plan. However, that Plan does not permit this <br /> structure in this location of the park. We conclude that the proposed use of the existing <br /> structure by Nearby Nature would be inconsistent with the Plan. <br /> I. Relationship of Alton Baker Park Plan to Eugene Code <br /> The park is zoned Public Land (PL) under the Eugene Code. The Alton Baker Park <br /> Master Plan has created separate zones within the park that designate certain uses and structures <br /> to be allowed in each of the park's zones and subzones. Although the Plan creates these new <br /> zones that implement the goals and policies, the requirements of the PL zone set forth in the <br /> Code still apply. <br /> II. Eugene Code Requirements for PL - Zoned Property <br /> The PL zone is primarily intended for public and semi - public uses_ The district is not <br /> intended for private uses by original or permanent occupants. EC 9.400. Among the permitted <br /> uses are public buildings and uses such as park and recreation facilities. EC 9.402(c). The City <br /> may contract with private entities or organizations to conduct or facilitate those public uses. <br /> Nearby Nature's use of the park would be considered a public recreational use by a private non- <br /> profit organization. <br /> III. Alton Baker Park Master Plan <br /> - Although the PL zone permits the proposed use, the Alton Baker Park Master Plan <br /> clearly prohibits it. The Goal of the Alton Baker Park Master Plan is "to` enhance the <br /> recreational opportunities of Lane County and Eugene- Springfield metropolitan area residents <br /> through the provision of park -type developments and facilities unique to the metropolitan region <br /> of the county. The "preservation of open space and wildlife habitat is another goal of the Alton <br /> Baker Park Master Plan_" <br /> The Plan is divided into two zones that implement these two goals and the Plan's <br /> policies: Zone 1 is the Natural Areas & Open Space zone.
