Environmental damages include, but are not limited to <br /> reonal injury, or injury to property or <br /> • _ (a) � D ges for. pe ama _ - ro rt and • <br /> ' natural resources upon or off of the p Pe Y' <br /> (b) Fees incurred for the services of attorneys, consultants, <br /> contractors, experts, laboratories and all other costs rea- <br /> sonably incurred in connection with the investigation nllo <br /> remediation of such hazardous materials, responding or lle <br /> gations of violations of environmental requirements, <br /> plying with any environmental requirement. Such fees anf <br /> costs include, but are not limited to, the preparation <br /> feasibility studies or reports or the performance of cleanup, <br /> remediation, removal, response, abatement, c tanyeenviron- <br /> sure, restoration or monitoring work required by a <br /> mental requirement_ <br /> b. COUNTY shall, at its sole cost and expense, promptly take all <br /> actions to comply with . every environmental requirement applicable to <br /> the Central Section of East Alton Baker Park or mediatem the <br /> herp <br /> party where remediation is due to the presence of <br /> upon, about or beneath, or migrating from the central Section iinio E a s : <br /> • Alton Baker Park. Such actions shall include, <br /> (1) the investigation of the environmental condition of the property; <br /> (2) the preparation of any feasibility studies, <br /> orpocomplianceewith rts or <br /> plans; and (3) the performance of any any environmental requirement, rnrestorationeworP, c _ whethereon'orp _ <br /> off <br /> ation, maintenance, monitoring o <br /> the Central Section of East Alton Baker Park. <br /> (i) Where any proposed action by COUNTY could affect the public's <br /> access to, or use and enjoyment of, any portion of the Central <br /> Section of East Alton Baker Park, COUNTY shall consult with EUGENE <br /> about the action COUNTY will implement. The proposed action to be <br /> implemented shall be (1) the least costly alternative consistent <br /> with all applicable environmental requirements, and (2) which <br /> minimizes the disruption to the public's use and enjoyment of the <br /> property. COUNTY and EUGENE recognize that the dual goals of <br /> least cost and minimum public disruption may conflict at times. <br /> If COUNTY and EUGENE are unable eSOOfaCOUtTYnand EUGENE acceptable <br /> shall <br /> native, then the governing bode governing bodies are <br /> to jointly choose an alternative.
