appropriate action, including, amendment or refinement of the Alton <br /> Baker Park Raster Plan or the Metropolitan Area General Plan. If <br /> - 'EUGENE or DISTRICT have concerns with elements of the East Alton Baker <br /> Park ' Plan, they shall identify those elements and reasons; -- and refer <br /> them to the CPC for modifications consistent with EUGENE'S or DIS- <br /> TRICT'S concerns. <br /> e. Following the CPC's completion of the East Alton Baker Park Plan, <br /> the CPC shall continue to meet to monitor its implementation, in con- <br /> sultation with EUGENE and DISTRICT staff. EUGENE and DISTRICT shall <br /> also meet and determine further work assignments for the CPC. <br /> 8. FUNDS. All parties agree to cooperatively pursue and apply for grant <br /> or other funds for improvements to the infrastructure or existing bike <br /> path system and watercourses within Alton Baker Park including the <br /> extension of the bike path to Island Park in Springfield. The improve- <br /> ments shall be consistent with the East Alton Baker Park Plan. <br /> 9. RELATIONSHIPS WITH UNIVERSITY. COUNTY and EUGENE agree to work to- <br /> gether to amend or revise current Intergovernmental Agreements with the <br /> University of Oregon to reflect changes in ownership of Alton Baker <br /> Park, consistent with this Agreement. These agreements include Main- <br /> tenance and Lighting of the Pedestrian Path from the Autzen Footbridge <br /> to Autzen Stadium, and reciprocal use of parking lots along the north <br /> side of East Alton Baker Park. In addition, the COUNTY shall revoke <br /> the Facility Permit that allows the University to use the meadow area <br /> for a hammer, discus, and shot put practice area. A new permit for <br /> this activity and facility will be granted to the University of Oregon <br /> at the sole discretion of EUGENE. COUNTY hereby assigns and transfers <br /> and EUGENE accepts all of the rights, duties and responsibilities of <br /> COUNTY under said agreements and permit, effective the date the trans- <br /> fer document transferring the Central Section of East Alton Baker Park <br /> is filed with Lane County Records. COUNTY retains all of its liability <br /> for actions under these agreements which took place, or should have <br /> taken place, prior to the date the transfer document is filed with Lane <br /> County Records. <br /> 10. BMX. COUNTY hereby assigns and transfers and EUGENE accepts all of the <br /> rights, duties and responsibilities of COUNTY under the terms of the <br /> COUNTY's lease agreement with Emerald Valley BMX (hereinafter "BMX <br /> Lease ") for use of approximately 5 acres of Alton Baker Park for <br /> bicycle motocross racing, effective the date the transfer document <br /> transferring the Properties is filed with Lane County Records. The <br /> County Administrator signed the BMX Lease on June 18, 1992 and the <br /> COUNTY recorded a Memorandum of Lease on December 10, 1992 (Recording <br /> Number 9269905). COUNTY retains all of its liability for actions under <br /> the BMX lease which took place, or should have taken place, prior to <br /> the date the transfer document is filed with Lance County Records. <br /> COUNTY will cooperate with EUGENE to amend the lease. <br /> 11. WATER RIGHTS. COUNTY agrees to transfer water rights perfected under <br /> Permits Number 20637, 14770, and 14883 to EUGENE. Permit Number 49552 <br /> 2.19.93 5 <br /> 1 <br />
