ADMINISTRATIVE ORDER NO. 58- 95 -09 -F <br /> of the <br /> CITY MANAGER OF THE CITY OF EUGENE, OREGON <br /> Policy and Procedures Regulating Vehicle Parking <br /> Off Improved Surfaces in Parks <br /> The City Manager of the City of Eugene finds that: <br /> A. Pursuant to the authority contained in Sections 2.019 and 5.040 of the Eugene <br /> Code, 1971, on June 22, 1995 I issued Administrative Order No. 58 -95-09 proposing the adoption <br /> of .policy and procedures regulating vehicle parking off improved surfaces in parks. <br /> B. Notice of the proposed amendments was published in the Register Guard for five <br /> consecutive days, to -wit, on June 25, 26, 27, 28, and 29, 1995. The Notice was also made <br /> available to persons who had requested notice, and provided that written comments would be <br /> received thereon for a period of 15 days from the first date of publication. <br /> C. Three comments were received in the manner required by the Notice, to which I <br /> make the following findings: <br /> Comment 1: The Executive Director of WISTEC expressed concern that the <br /> parking fee requirement of Subsection 3.6 of the Policy and Procedures would seriously <br /> interfere with the current contractual relationship WISTEC has with the University of <br /> Oregon to allow overflow parking in the WISTEC paved lot and grassy surfaces during <br /> home football games. The amounts received from the U of 0 are not large, but are vital <br /> to the continued operation of WISTEC. <br /> Finding: In response to this comment, staff has recommended that the Policy and <br /> Procedures be revised to allow the Parks Operation Manager to waive the requirement to <br /> charge and/or pay the parking fee to the City for those events that are limited to one day <br /> only, providing the promoter is in compliance with other requirements of the rule. I <br /> concur with the staff's recommendation, and the waiver provision has been added to the <br /> rule. <br /> Comment 2: The President of the Japanese - American Association of Lane County <br /> indicated that it most likely would be unable to comply with the application requirements <br /> of the Policy and Procedures for its annual O'Bon Festival which is scheduled for July 29, <br /> 1995 in Alton Baker Park, and requested that the proposed rules not be adopted, or in the <br /> alternative not become effective until after July 29, 1995. <br /> Administrative Order - 1 <br />
