Agency /State <br /> Agreement No. 26219 <br /> 5. The Willamalane Park and Recreation District owns and operates the portion of WNA <br /> that lies east of State's 1 -5 right of way and has responsibility for the eastern segments <br /> of the Canoe Canal structure, design enhancements, landscaping features, and three <br /> (3) multiple -use paths and a soft - surface trail, known as Pre's Trail up to the centerline <br /> of the 1 -5 right of way with in the boundary of City if Springfield. <br /> 6. Two multiple -use paths cross the 1 -5 right of way, connecting Agency's portion of the <br /> WNA to Willamalane's portion of WNA. One of the multiple -use paths crosses State <br /> right of way at the Patterson Slough (aka Canoe Canal) underpass. The other <br /> multiple -use path crosses State right of way at the Walnut Road underpass. A soft- <br /> surface running trail, known as Pre's Trail, extends through State 1 -5 right of way at <br /> the Canoe Canal underpass. <br /> 7. Through this Agreement State wishes to grant Agency authority to access to the <br /> western slope area of State's 1 -5 right of way, up to State's right of way fence line for <br /> the sole purpose of removal and control of graffiti, invasive and toxic vegetation, litter <br /> and hazardous debris within the slope area as indicated in this agreement. State does <br /> not grant the public access to 1 -5 right of way slope area. <br /> 8. This agreement, between State and Agency provides for the design, permitting, <br /> reconstruction and /or construction and maintenance of Canoe Canal, multiple -use <br /> trails, soft- trail, landscape features and design enhancements within Agency's portion <br /> of WNA that lies between the western boundary of State's 1 -5 right of way and the <br /> centerline of State's 1 -5 right of way. <br /> NOW THEREFORE, the premises being in general as stated in the foregoing recitals, <br /> which are incorporated as part of this Agreement, it is agreed by and between the <br /> Parties hereto as follows: <br /> STATEMENT OF WORK <br /> The work to be performed under this agreement will be conducted through the State <br /> and Agency and shall provide for reconstruction and /or construction, continual <br /> operations and maintenance of Agency portions of the above mentioned Canoe Canal, <br /> multiple -use paths, soft - trail, landscape features and design enhancements that across <br /> State right of way and the western slope area of 1 -5. Operations and maintenance costs <br /> related to the portions of the Canoe Canal, multiple -use paths, soft -trail and landscape <br /> features that lie in Agency's portion of WNA and between the western boundary of <br /> State's right of way and the center line of State's 1 -5 right of way and western slope <br /> area of 1 -5 are the responsibility of the Agency. State will reconstruct and /or construct <br /> portions of Canoe Canal, multiple -use paths, soft - trail, landscape features and design <br /> enhancements within State's 1 -5 right of way and designated areas in Agency's portion <br /> of WNA. State will provide Agency a one time lump sum payment for maintenance of <br /> design enhancements.
