HAYS.1 Page 1 <br /> MEMORANDUM <br /> TO: Hays Memorial Trust Fund File <br /> FROM: Jim Johnson, Executive Manager <br /> Department of Library, Recreation, and Cultural Services <br /> SUBJECT: Vision for Hays Memorial Tree Garden <br /> DATE: December 23, 1994 <br /> Background <br /> On December 16, 1994, I had a conversation with an anonymous donor who wished to donate a <br /> large sum of money to the City of Eugene to establish a Memorial Tree Garden in Alton Baker <br /> Park. The donor wished to create the Hays Memorial Trust to implement the project. On <br /> December 20, I received a check on behalf of the city in the amount of $100,000. Under the <br /> terms of the Trust Agreement, $70,000 can be spent to implement the project described in this <br /> memo. The balance of $30,000 is used to establish an endowment from which interest earnings <br /> are used for maintenance of the project. <br /> During my discussions, I agreed to write this memo to explain the project. The main purpose of <br /> the memo is to ensure that the City understands the donor's wishes and the donor's vision for the <br /> project. On December 20, the donor reviewed the project description contained in this memo and <br /> agreed with its content. <br /> To the extent possible, the donor desires that the City keep the details of this project and the <br /> existence of the Trust confidential for the foreseeable future and at least the next two years. After <br /> consulting with the City Attorney, I explained to the donor that the source of the funds could <br /> remain completely confidential for as long as the donor desires, but that the existence of the Trust <br /> Fund and the project may or may not become public knowledge within the next two years. The <br /> main reason for this is that a budget account must be established, the account will be named the <br /> Hays Memorial Trust, and the Budget Committee and then City Council adopt the budget which <br /> contains the trust fund. City staff will comply with State law for the disclosure of public <br /> information, but will not overtly make known the existence of the Trust or this project unless <br /> specifically requested to do so. <br /> P <br /> Project De cr pt on/V on for the Hay Memor al Tree Garden <br /> The donor is aware that master plans for Alton Baker Park written in 1973, 1979, and 1986, all <br /> include an element called a "Tree Garden."
