DRAFT BAMBINO BASEBALL FIELD E AGREEMENT rrYTT <br /> The parties to this Lease Agreement are THE CITY OF EUGENE (hereafter, the <br /> "Owner ") and WILLAMETTE VALLEY BABE RUTH BASEBALL, INC. (hereafter, "Lessee "). <br /> The effective date of the Lease Agreement is October 1, 1997. <br /> RECITALS: <br /> A. Lessee's board members and supporters have started a project to build Bambino Baseball <br /> Fields for use of Lessee. Lessee wishes to lease property from Owner to construct, and thereafter <br /> use and operate, the baseball fields. <br /> B. Owner lacks funds to construct baseball fields but wishes to have the baseball fields <br /> constructed and available for use by the public. <br /> C ; Owner and Less ee, agree that in order to maxhuizethe use of th , basebali fields, Lessee <br /> shall encouragelise encourage by altmemb rs of the public, including those individuals who ;paatcipate -in <br /> Lessee's rograms as well as those users who participate in, other commu t recreational sports <br /> groups. <br /> IN CONSIDERATION OF THE MUTUAL AGREEMENTS contained herein, the parties <br /> agree as follows: <br /> 1. Lease. Owner shall lease the premises, depicted in the cross - hatched area on Exhibit A, <br /> which is attached hereto and incorporated by this reference. Lessee shall have the exclusive use <br /> of the premises during the time needed for construction solely for the purpose of constructing the <br /> baseball fields. Thereafter, for the remainder of the lease term, Lessee shall have the non- <br /> exclusive use of the premises as provided in paragraph 8 of this lease. <br /> Bambino Baseball Fields Lease Agreement - 1 <br />
