Further, a
time and place for the informal hearing was scheduled within 72 hours (exclusive of weekends)
of receipt of the request for an informal hearing.
I outlined the format of the informal hearing — I would call each speaker in turn; those not
speaking were not to interrupt the speaker; and comments, questions, and answers should be
directed to me and not to others present at the informal hearing. I also stated the order I would
take testimony would be City police, person requesting the hearing and witnesses. In addition, I
stated that I may ask additional questions.
I confirmed there were no witnesses that would provide testimony.
Testimony
Officer Dawson summarized the events leading to the Notice of Restriction of Use being issued
to Kegan Craig. The summary was consistent with the narrative in the citation issued.
Kegan Craig asked if there was a warrant issued that allowed his backpack to be searched.
I stated I did not know if a warrant was issued and it was not germane to the Notice of
Restriction of Use.
Decision
Based upon the testimony presented at the informal hearing the Notice of Restriction of Use —
Case #12 -13131 (attached) is hereby affirmed.
i
Mark Schoenin Date August 9, 2012
Acting Parks and Open Space Director
