The recently renewed leases will be honored as written, but due to a <br /> change in policy by the Parks and Open Space Division, the leases will not be renewed when the <br /> existing term ends at midnight, March 14, 2005. <br /> At that time, per Section 10 of your lease, "...the property will either be returned to original good <br /> condition free from any refuse or debris and any fencing installed, or the property shall be turned over <br /> as currently improved if requested in writing by the City." <br /> If you sell your property prior to the expiration of the lease, the lease will terminate as per Section 10. <br /> You are responsible to inform the City that you intend to sell your property prior to closing of a sale - <br /> 90 days ahead of time if possible - to allow the City to determine the condition of the property that will <br /> be required at the time it is turned back to the City. The termination will occur no earlier than 90 days <br /> after your notification that you intend to sell, or immediately at the time of the sale. Please note that <br /> the existing leases are not transferable to a new owner. <br /> The Parks and Open Space Division may choose to continue to offer use of the land to you after <br /> March 14, 2005, or to a future owner, under the terms of a use permit rather than a lease. The <br /> determination to grant a permit will be made on a case -by -case basis reflecting what is deemed to be <br /> in the best interest of the public at that time. <br /> Section 3 of your lease agreements regarding Purpose and Use also needs to be modified to reflect <br /> that although there is no longer a City of Eugene Open Waterway Ordinance, Section 6 of the Eugene <br /> Code prohibits dumping of debris on public -owned property. <br /> Please be aware that it is against federal, state, and local law (City of Eugene Ordinance Section <br /> 6.446, 6.805, 6.655, and 6.010) to discharge non - stormwater substances, including biodegradable <br /> substances, into the stormwater collection system, which includes street gutters, storm drains, and <br /> open channels. Prohibited materials include brush, vegetation (including grass clippings), and other <br /> debris. Violations of these sections of the code are classified as nuisances and are subject to <br />
