You
have asked if the 10 wide strip of park land along the eastern boundary of your property was an
easement or if the city actually owned it. I have reviewed the 1989 bargain and sale deed in
which Lane County transferred ownership of Awbrey Park to the City of Eugene. This deed
shows that the 10 foot wide strip of land is actually part of the Awbrey Park parcel and is
presently owned by the City of Eugene.
Anticipating your willingness to proceed with a land trade, I have drawn up a sketch of what
this trade might look like. (please see attached) Each area is approximately 2058 square feet in
size. The 10'x205.77' area highlighted in yellow is the part the city would deed to you. The
trapezium shape (roughly 27'x70'x63'x41.86') highlighted in green is the part you would deed to
the city. If you agree to this configuration, I will have our property management office initiate
action to accomplish the trade. A more precise drawing would need to be prepared for the
required formal lot line adjustment.
As we discussed, this trade should be beneficial to both parties. Both pieces of land contain
existing trees and there is a mutual desire to preserve as much of the natural vegetation as
possible. The 10 foot wide strip of land added to your property would increase the effective
buffering between your property and the new subdivision to the east. The trapezium shape at the
southern tip of your property is of little use or value to the rest of your property as a whole and, if
part of Awbrey Park, would allow us to reduce the awkwardness of the pedestrian access point
that is partially developed at this time.
If you would please signify your willingness to proceed with the trade as proposed, by signing
and returning one copy of this letter in the envelope enclosed, I will get the process started at our
end. Thank you for your cooperation. If you should have any questions please don't hesitate to
contact me at 465 -2812.
Sincerely,
( . - t'rirt/
acknowledged by - .
/ /
Jo Weber, Parks Planner M. 7. • en)
