CC Newsletter Article
May , 1995
MINOR BOUNDARY ADJUSTMENT AT AWBERY PARK
Awbrey Park is a partially developed 5.17 acre park located at the northeast corner of River Road
and Spring Creek Lane. This park was conveyed to the City with revisionary rights by Lane
County in 1989. Spring Creek Subdivision, which abuts the park property on the north, has
recently provided a bike /pedestrian path connection from Culmet Avenue to the northern
boundary of Awbrey Park. This new path connection made an existing 10' by 205.8' pan handle
extension of the park originally intended to provide this access unnecessary.
The alignment of the new path to the park property resulted in a 90 degree turn of the 12 foot
wide path which was determined to be awkward and unsafe to bicyclists. A minor adjustment to
the park boundary was needed in order to allow room to smooth out the sharp turn. In order to
accomplish this, staff entered into negotiations with the adjacent property owner on the north,
Mary Cohen (Cohen Family Trust). An agreement has been reached to exchange the 2058
square foot pan handle no longer needed for a similar amount of land at the southern portion of
her property. Mary Cohen has agreed to this exchange as long as no exchange of funds is
required. The City's Real Property Officer has determined that the properties to be exchanged
are of equivalent size and value. At the request of City Staff, Lane County has released its
reversionary rights on this 2058 square foot piece of land to allow this transaction to occur.
The City will handle the document preparation, recording, and survey the new property lines, if
needed. Deeds will be exchanged upon final approval of the City Manager, and in accordance
with real property procedure provisions in Eugene Code Section 2.860 through 2.874. Staff
anticipates that final documents will be ready for processing in late June of 1995. For more
information, please call John Etter or John Weber at 687 -5220.
