Box 1338 <br /> Eugene, Oregon 97440 <br /> Dear Clayton Walker: <br /> This Letter of Agreement addresses a proposed park acquisition and the possibility of a land <br /> exchange in the area of your subdivision north of Crescent Street, immediately west of Game <br /> Farm Road. The information shared in the recitals below, and the proposed actions by each <br /> party, have been discussed informally between yourself and John Etter of the Parks Planning <br /> Office at Public Works Maintenance. This letter, when signed by you (representing Terra <br /> Buono Properties III) and Christine Andersen (representing the City of Eugene), will serve to <br /> formalize the plan by which we proceed. <br /> RECITALS <br /> 1. Terra Buono Properties III (Developer) is developing a residential subdivision, proposed <br /> to be phased over an approximate 4 year period, in an area of northeast Eugene, abutting <br /> Crescent Street on the south side and Game Farm Road on the east side (refer to attached <br /> Exhibits A and B). <br /> 2. The City of Eugene (City) owns park land adjacent to the west side of the northerly third <br /> of the Developer's parcel (refer to attached Exhibit B). The park was purchased to provide the <br /> opportunity for future development of a neighborhood park, and or lighted sports fields, off - <br /> street parking and rest rooms, all in cooperation with school (4-J) sports field development to the <br /> west. Ball field lights, which will be used during periods when adult league play is scheduled, <br /> will be aimed and shielded to minimize lighting impacts on adjacent residential development. <br /> 3. Based on park development standards and current information about future growth and <br /> development of the area, it has been determined that a neighborhood park would serve the <br /> residential population better if it were located south and east of parcel of land owned by the City. <br /> 4. The Developer has expressed an interest in having the neighborhood park be located in <br /> the third subdivision phase, scheduled to be developed in the 1996 construction season, or as <br /> soon thereafter as Developer deems reasonable and practical. <br /> 5. The City Parks Planning Section is responsible for providing park development plans, <br /> designs and development oversight. However, no time line for the completion of such planning <br /> and development for a neighborhood park in this area has been established. <br />
