DRAFT <br /> AGENDA ITEM SUMMARY ItemNo.: (Consent <br /> Calendar) <br /> Meeting Date: ?? <br /> E U G E N E C I T Y C 0 U N C I L Department: Public Works <br /> ITEM TITLE: Fox Hollow Road Property Sale to Cascades Raptor Care Center <br /> ACTION REQUESTED: Authorize staff to negotiate and execute an agreement with <br /> Cascades Care Raptor Care Center for the sale of the city <br /> owned property at 32275 Fox Hollow Road under the general <br /> conditions outlined in the briefing statement below. <br /> BRIEFING STATEMENT: The City owns a house on four acres located at 32275 Fox <br /> Hollow Road. This parcel was acquired in 1983 to settle a property dispute <br /> arising from an encroachment by the ridgeline trail. This property has been <br /> managed since it's acquisition as a rental homesite and is currently vacant. <br /> Staff has determined it financially impractical to make facility improvements <br /> required by the Americans with Disabilities Act (ADA) and the building code <br /> which are required for the property to be operated as a city owned facility <br /> open to the public. Therefore, the property is considered not suitable for <br /> public use and is surplus property. 4 <br /> Cascades Raptor Care Center (CRCC) has offered to purchase this property from <br /> the city. CRCC has requested several financial concessions be granted by the <br /> city in order to help CRCC develop this property. This request has merit <br /> since CRCC's use of the property will be supportive of a goal stated in the <br /> Parks and Recreation Plan for the development of a nature interpretive center <br /> on this site. Staff is in basic agreement with CRCC that proceeding with <br /> negotiations and a subsequent sale of this property would be in the best <br /> interest of both parties. The City Attorney's office has returned an opinion <br /> that this transaction may be executed by staff with the agreement of the City <br /> Council. <br /> The proced being proposed is as follows: <br /> 1. The property boundaries will be adjusted to exclude the ridgeline trail. <br /> 2. An appraisal of the property will be conducted by Lane County staff. The <br /> appraisal will be the sale price for the property. This price is <br /> expected to be in the range of $ 100,000 - $ 130,000. <br />
