RAP,TOR.CC Page 1 <br /> AGENDA I T E M SUMMARY Item No.: (Consent Calendar) <br /> Meeting Date: November 22, 1993 <br /> E U G E N E C I T Y C 0 U N C I L Department: Public Works <br /> ITEM TITLE: Fox Hollow Road Property Sale to Cascades Raptor Care Center <br /> ACTION REQUESTED: Authorize staff to negotiate and execute an agreement with Cascades <br /> Care Raptor Care Center for the sale of the city owned property at <br /> 32275-Fox Hollow Road under the general conditions outlined in the <br /> briefing statement below. <br /> BRIEFING STATEMENT: The City owns a house on four acres located at 32275 Fox Hollow <br /> Road. This parcel was acquired in 1983 to settle a property dispute arising from an <br /> encroachment by the ridgeline trail. This property has been managed since it's <br /> acquisition as a rental homesite and is currently vacant. Staff has determined it <br /> financially impractical to make facility improvements required by the Americans with <br /> Disabilities Act (ADA) and the building code which are required for the property to be <br /> operated as a city owned facility open to the public. Therefore, the property is <br /> considered not suitable for public use and is surplus property. <br /> Cascades Raptor Care Center (CRCC) has offered to purchase this property from the city. <br /> CRCC has requested several financial concessions be granted by the city in order to <br /> .help CRCC develop this property. This request has merit since CRCC's use of the <br /> property will be supportive of a goal stated in•the Parks and Recreation Plan for the <br /> development of a nature interpretive center on the site. Staff is in basic agreement <br /> with CRCC that proceeding with negotiations and a subsequent sale of this property <br /> would be in the best interest of both parties. The City Attorney's office has returned <br /> an opinion that this transaction may be executed by staff with the agreement of the <br /> City Council. <br /> The procedure 'being proposed is as follows: <br /> 1. The property boundaries will be adjusted to exclude the ridgeline trail. <br /> 2. An appraisal of the property will be conducted by Lane County staff. The <br /> appraisal will be the sale price for the property. This price is expected to be <br /> in the range of $ 100,000 - $ 130,000. <br />
