Park restriction hearing for Gene Moodey <br /> PURPOSE <br /> This informal hearing is response to a request from GENE T. MOONEY to appeal the Notice of Restriction <br /> of USE he received on October 22, 2002. Is Mr. Mooney present? <br /> An officer of the Eugene Police Department issued the restriction of use. The restriction of use was based <br /> on a violation of Park Rule 1.010 (m) for aiding and abetting a person protesting in the Park Blocks through <br /> tree sitting. The Park Blocks are located generally at 8 Avenue and Oak Street. Is Officer Curry present? <br /> The restriction of use prohibits entry or use of any City of Eugene Park and recreation facility or <br /> participation in City sponsored recreation programs or activities until November 22, 2002. <br /> Our purpose here is to review Gene T Mooney's appeal of this restriction and to determine if the restriction <br /> is warranted. <br /> PROCEDURE <br /> This is an informal hearing but I wish everyone to understand how we are going to proceed. <br /> First, I will ask Officer Curry who issued the restriction to relate the events, conduct observed from Mr. <br /> Mooney, and the basis for her decision to issue the restriction. <br /> Second, I will ask Officer Dodds to relate the events and conduct he observed. (ONLY DO THIS IS <br /> OFFICER DODDS IS PRESENT) <br /> I will then ask Mr. Mooney to relate the events as they happened and to explain why he feels the restriction <br /> is in error. <br /> Finally I will ask if there is any other witness accounts of the events and conduct of Mr. Mooney. <br /> Please remember to address all your comments to me and not to other people involved in this hearing. <br /> If anyone wishes to ask a question of anyone else here regarding information presented at this hearing, <br /> please address that question to me. If I feel the question is appropriate then I will present the question for <br /> response. <br /> Once I have hear all the relevant testimony I will then render a decision regarding the appeal. <br /> INTERVIEWS <br /> Officer 1 — Officer Curry Officer 2 — Officer Dodds <br /> Gene Mooney Other witnesses <br /> Recess for 10 minutes — <br /> DECISION <br /> I find that the events as alledged in the Notice of Restriction of Use did/did not occur. <br /> Present decision — Potential actions — Overturn restriction — Affirm Restriction — Modify Restriction <br /> A written decision will be mailed to you within 5 working days. Any subsequent appeal timelines shall <br /> begin on the date of the written decision. <br />
