We have also, <br /> along with the appraiser, considered your supplemental information concerning how the <br /> remaining property could be considered damaged over and above the appraised price with the <br /> purchase we propose. Based on these evaluations we can not find a basis to use for payment of <br /> damages that are theoretical or speculatory. <br /> The City is obligated to pay market value, as determined by an appraiser and appraisal review. <br /> This is to protect the interest of the property owner, as well as the expenditure of public money. <br /> The parcels used by the appraiser for comparison were largely similar in terms of size, access, <br /> slope, utility impacts, and unknowns about adjacent parcels. Sale or listed prices of the <br /> comparables include the negative aspects which you refer to as ways that a property value is <br /> lowered (or damaged). The negative aspects and unknowns that went with the comparison <br /> parcels are, of course, factors leading the prices of those that sold. <br /> Based on the appraisal, the City of Eugene makes the following offer to purchase 35 acres <br /> roughly concentric to the top of Moon Mountain, as shown on Exhibit A, which includes: <br /> 22.70 acres inside the UGB for $23,000 per acre $522,100 <br /> 12.30 acres outside the UGB for $4,700 per acre 57.810 <br /> Total price: $579,910 <br /> Subject to a verbal acceptance of this offer, we will create a metes and bounds description of the <br /> parcel shown and have it attached as a second exhibit (Exhibit B) to this offer. Once Exhibit B is <br /> attached, we would expect a formal acceptance by receiving from you a signed copy of this <br /> letter. <br />
