No more than 40 percent of the <br /> buildable area of each solar lot may be shaded by the mature height <br /> of existing non -solar friendly vegetation measured by the shade <br /> cast at noon on December 21, whether such vegetation is located on <br /> or off the lot. Selective removal of vegetation ten feet or less <br /> in height prior to final land division is required to meet this <br /> standard. <br /> 7. Protection from future shade. On land located in the <br /> RA, R -1, R-2, R-3, R -4 and C -1 zoning districts, a land divider <br /> shall affix deed covenants and restrictions of title to the title <br /> of lots as are required to protect adjacent solar access protection <br /> for adjacent lots shall be equivalent to the protection afforded by <br /> the solar setback standards set out in section 9.535(4) for the <br /> applicable zoning district. <br /> (k) Conservation land divisions. Conservation land divisions are <br /> intended to facilitate the sale or donation of valuable natural resource <br /> areas to public or non - profit agencies for long -term protection and <br /> management by dividing conservation areas and remaining areas into <br /> separate parcels. <br /> 1. Conservation parcels are those set aside and managed <br /> or protected to conserve natural resource values including wildlife <br /> habitat, ecological significance. rare or endangered species, water <br /> quality, and flood storage and control. Conservation parcels are <br /> primarily undeveloped and natural. Conservation parcels shall have <br /> no minimum standards for lot area, frontage, width or depth. <br /> 2. Remainder parcels are those that are not being <br /> protected for natural resource values. Remainder parcels may be <br /> developed, partly developed or undeveloped. The planning director <br /> may authorize exceptions to the minimum platting standards for lot <br /> area. lot frontage. lot width and lot depth for remainder parcels <br /> provided that the following standards are met: <br /> a. At least one of the lots created must be a <br /> conservation parcel and must be rezoned to NR district prior <br /> to or concurrent with land division. <br /> b. The number of remainder parcels created must be <br /> the least number that will accomplish the purpose of the <br /> conservation land division. <br /> c. Exceptions to minimum lot and parcel platting <br /> standards will not be allowed on residentially zoned <br /> remainder parcels. <br /> d. On remainder parcels, exceptions to minimum lot <br /> and parcel platting standards in agricultural, commercial <br /> and industrial zones will be no more than the minimum needed <br /> to accomplish the purpose of the conservation land division. <br /> 3.
