Date: 12/15/92
From: John Etter CERMJFE - RIS1
To: Les Lyle CEWELAL - RIS1
Bob Hammitt CEWMJRH - RIS1
cc: Johnny Medlin CEWMJRM - RIS1
Bud DeSantis CEWEBLD - RIS1
Joe Ferguson CEWEJMF - RIS1
Walt Haniuk CERMWJH - RIS1
Subject: Polk Street eligibility for state grant funding
I got to speak to an official in State Parks this morning about whether the
eventual creation of street right -of -way would jeopardize funding under terms
of the matching grant. The answer was that it would, so that seems to be an
effective death knell for that improvement at this time.
One piece of information that we uncovered is that the land on which the im-
provement was to be made, which we have for years assumed to be park land, was
purchased in 1914 by the City for a sewer easement. At this point I would
hope that we could establish /agree that its has not been park land. As Bob
and Johnny know, we have recently become aware that mitigation measures are
required (fed. reg.) when land on which park and recreation improvements have
been made with federal funding are reduced in size, or otherwise undergo a
conversion to a non -park and recreation use. Many federal grant dollars have
been spent on this section of park, but not exactly on this 50' "easement."
We need interpretations and records to reflect non -park status; the deed in
hand is a good start.
