EUGENE Public Works <br /> Maintenance <br /> City of Eugene <br /> 1820 Roosevelt Boulevard <br /> Eugene, Oregon 97402 <br /> (541) 682 -5220 <br /> July 24, 1997 <br /> Pat Kilby <br /> RDT Development Inc. <br /> 3610 Goodpasture Loop Road <br /> Eugene, Oregon 97401 <br /> Dear Pat Kilby: <br /> This Letter of Agreement concerns the understanding by which land within the Hawkins View <br /> Subdivision, Phase 2, would become City property. <br /> Contiguous to the park that the City of Eugene (City) has agreed to purchase from RDT <br /> Development (Developer) in the Hawkins View Subdivision, Phase 2, lays a filled pond, a <br /> wetland area, and an area to be established as a wetland between the filled pond and existing <br /> wetland. A wetland fill permit requires certain work to be done on those areas in conjunction <br /> with the filling of the pond. See attached Exhibit A. <br /> The Developer has proposed donating these contiguous areas that are not developable to the City <br /> for management as natural areas, and as part of the park. City staff have determined that this <br /> proposal should be accepted, subject to the performance objectives required under the wetland <br /> fill permit being achieved. A copy of a letter of stating that objectives have been achieved from <br /> the permitting agencies would allow the City to accept the property and assume responsibility for <br /> maintenance. A letter acknowledging receipt of the property as a donation would then be sent to <br /> the Developer. <br /> If you are in agreement with the procedure described above for conveying the wetland areas to <br /> the park, please sign in the space provided below on each of three copies and return them for the <br /> City's representative to sign.
