of -way, with the potential for additional access from future development <br /> that occurs within the urban growth boundary. The channel acquisition <br /> will also provide a link to the Belt Line Road right -of -way, on which an <br /> off -road bike path could be developed. A path could extend westerly from <br /> Belt Line Road through a reconfigured park. <br /> - - Retaining the possibility for a water oriented park is desired . Two <br /> telephone comments were received from park neighbors expressing dis- <br /> appointment that they might be deprived of the pond experience. Staff <br /> also received a letter from a representative of the Willamette Valley <br /> Retriever Club, which has used the ponds for their training and events <br /> for about 18 years. That letter and a written response that followed an <br /> earlier verbal response are attached. <br /> - - Open space in conjunction with a drainage channel is desirable. This <br /> will provide opportunities to make wetland /riparian /water quality enhance- <br /> ments similar to those that are contemplated along the Amazon Channel. <br /> These could include various recreational and educational benefits. Re- <br /> taining the southern pond is seen as a reasonable response, given other <br /> factors involved. <br /> -- Concerns of the Department of Fish and Wildlife were expressed in an <br /> attached letter of 7/7/92. The proposed golf plan does not call for modi- <br /> fying the ponds for any tee, fairway, green or other purpose. The devel- <br /> oper's concern is to prevent the non - golfing public from using an area <br /> which errant golf balls may occasionally enter, and to reduce the perime- <br /> ter they have to maintain. The upland and riparian areas around the ponds <br /> in the traded parcel would remain intact for wildlife habitat values. <br /> - - Including the drainage channel in the reconfigured park, the total acreage <br /> would amount to 33.37 acres. This puts it in a class with other community <br /> parks that include drainage channels: Amazon Park - -79.45 acres; <br /> Westmoreland - -46.85 acres; and Petersen - -18.01 acres. A suitable area <br /> will exist for the development of a small playfield and playground commen- <br /> surate with the neighborhood it serves when the City is better able to <br /> fund and maintain such park improvements. <br /> - - Fencing would occur at the developer's expense along the south edge of the <br /> new property line. The City would provide standard barricading to prevent <br /> four - wheeled vehicles from accessing the maintenance strip along the north <br /> side of the channel adjacent to the golf development. <br /> -- The memo of 6/25/92 in response to questions by Councilor Boles is at- <br /> tached. This proposal seems to be consistent with both that response, and <br /> with the six guiding conditions listed in the 9/14/92 project update memo. <br /> Prior to the execution of any trade, one housekeeping measure needs to happen <br /> with the County Commissioners. When the county deeded the property to the <br /> City, it came with a deed restriction stating the land was to be used for <br /> park purposes only. Because use as a golf course may be interpreted as not <br /> being for park purposes, we will need to seek a release from that restric- <br /> tion. A staff member made an informal poll of the County Commissioner and <br /> found support from those responding toward waiving the restriction. Inquiry <br /> memo of 12/24/92 is attached. <br />
