Morgan, Dick
From: Morgan, Dick
To: Hammitt, Bob; Shutt, Gene; Medlin, Johnny
Cc: Stansfield, Adrian; Rhay, Tim; Grissell, Dee
Subject: Golden Gardens Ponds -- Drowning - -
Date: Friday, July 08, 1994 11:40AM
Bob, I'm sure that you have read about the drowning that occured at Golden Gardens on thur.7 /7. Johnny
and I went out the first thing fri. 7/8 and toured the property. Later that morning I toured Myrnie Daut,
Cathy Josephs, and Gene Shutt over the property giving them an idea of the maintenance performed, the
Park Rule signs that are posted and the various uses of the park by the neighbors, Dog and Boat clubs,
fishing etc. that goes on in the area. Maintenance is minimal with a once a year mowing where possible,
with garbage pickup be to performed on an as needed basis or by the clubs that use the area for their
activites! We do not restrict access to the park because of the natural resources that people like to use.
We do not post NO SWIMMING signs because the law does not require governmental agencies to post
natural body's of water, rivers, lakes, ponds etc.. In fact posting of such area brings a higher level of
liability! The fencing and gating are to restrict access to motor vehicles to the area. This is next to
impossible since there are access points to the fields surrounding the ponds that the City has no jurisdiction
over! I hope this helps if you get any questions next week.. Cathy has some case studies that relate to
water features and their signage if you need further information.
