As <br /> indicated in the chronology, Mr. Wright had contact with Parks <br /> employees in 1972 relative to removal of downed trees as a result of the <br /> 1972 ice storm and removal of blackberries and underbrush in this <br /> area of the park. There was no determination or discussion as to the <br /> precise location of the park boundary at that juncture. <br /> The Wright dwelling is at the bottom of a draw, which resulted in <br /> drainage problems during periods of heavy rain. This was addressed by <br /> the engineering of a wall with the approval of the City Public Works <br /> personnel. Subsequent to that time, Mr. Wright installed sprinklers to <br /> water the landscape and for fire suppression. Further improvements <br /> were made in 1987 and 1988 to the retaining wall and drainage behind <br /> the wall. <br /> In 1995, the City completed a survey and it first became apparent that <br /> the boundary of the park was much closer to the Wright residence than <br /> Mr. Wright, and, as far as I know, City personnel were aware. It was at <br /> that time that the Revocable Permit was executed by the City and Mr. <br /> Wright. Mr. Wright has complied with all requirements of the permit <br /> and has not made additional improvements in the encroachment area. <br /> I understand that the City's changed policy towards the continued use <br /> of the encroachment area by Mr. Wright is based upon the City's <br /> adoption of the Hendricks Park Forest Management Plan (Plan) in May <br /> 2000. In reviewing that Plan, I could not find any mandate that <br /> requires that any consideration to existing conditions should be put <br /> aside and, under no circumstances, should the City work with adjacent <br /> property owners on these boundary issues. <br /> In Chapter 1: Executive Summary 86 Plan Overview of the Plan, Plan <br /> Highlights include the following: <br /> "9) Implement Stewardship Management of the Park Edge <br /> Develop a partnership with adjacent property <br /> owners to `adopt the forest edge' and work toward <br /> mutual goals. Assess and monitor encroachments <br /> of private use onto parkland and aggressively take <br /> action if required to restore integrity of the park <br /> edge. Prepare a boundary survey of the entire park. <br /> Monitor all proposed urban development around <br />
