JUN -17 -2002 10:49 SD4J FACILITIES MANAGMENT 1 541 687 3686 P.02/02 <br /> OWNERS: School District 4J <br /> PROJECT: Gilham Park Development Project <br /> MAP AND TAX LOT: 17 -03 -08-43 <br /> PARCEL NO.: 00600 <br /> PARCEL NO.: 06503 <br /> PERMIT OF ENTRY <br /> The City of Eugene has determined a need to either lease or purchase portions of the properties known as <br /> tax lot number(s)00600 and 08503 on Lane County Assessors map number 17- 03- 08-43, for the above <br /> described project. This area is better defined on the attached legal descriptions (exhibit A & B) and <br /> drawings (exhibit C & D). The City has offered to purchase or trade lands of equal value for the needed <br /> portions of the subject properties. <br /> In order to allow the City of Eugene, a political subdivision of the State of Oregon, to proceed with the <br /> design and development of the proposed public improvement project, the undersigned Grantor hereby <br /> grants the City of Eugene, its employees, agents, or contractors, an irrevocable permit to enter upon the <br /> real property delineated on the attached map to perform surveying and construction work related to the <br /> above described project. The subject area is the property of the existing Offer to Purchase by the City of <br /> Eugene. This permit also grants permission for the City or its contractors to enter upon our remaining <br /> adjacent property to perform survey work or other work which is beneficial to the property, such as <br /> driveway connections, matching of ground contours, and other work that may minimize impact on the <br /> subject property. <br /> We understand that by granting this permit the right of payment prior to possession, as provided by Public <br /> Law 91 -646, Section 301(4) and ORS 281.060 is hereby waived. <br /> The granting of this permit will in no way jeopardize our rights in negotiating a settlement or in any legal <br /> proceeding that may arise from the City's acquisition of said land. <br /> This permit is granted to avoid delay in constructing the project and indicates our willingness to cooperate <br /> in a spirit of good faith.
