ADMINISTRATIVE ORDER NO. 58-10-04 <br /> of the <br /> Executive Director of the Public Works Department <br /> ORDERING THE TEMPORARY CLOSURE OF A PORTION OF <br /> SCOBERT PARK. <br /> The Executive Director of the Public Works Department finds that: <br /> A. Pursuant to the authority of Administrative Order No. 21 -03 -12 issued by the City <br /> Manager, the Executive Director of the Public Works Department is authorized to regulate City <br /> parks, protect park visitors and the park environment, and adopt rules regarding the use of parks. <br /> B. Section 1.003 of the Parks and Open Space Rules, adopted by Administrative <br /> Order No. 58- 09 -11 -F, authorizes the temporary closure of all or any portion of a park, open <br /> space, or facility upon finding that conditions that threaten the welfare or safety of nearby <br /> ' residents exist and the need to preserve their welfare and safety outweighs the public's right of <br /> access to the park, open space and/or facility. <br /> C. A portion of Scobert Park, located at 1180 West 4 Avenue, has become a haven <br /> for illegal activities creating an atmosphere that threatens the welfare and safety of the residents <br /> in the area. Efforts to curtail the illegal activities, including the fencing of the area, have been <br /> unsuccessful. <br /> D. The need to protect and preserve the welfare and safety of residents living nearby <br /> Scobert Park outweigh the public's right of access to the fenced portion of Scobert Park. <br /> Now, therefore, based on the above findings, which are hereby adopted: <br /> IT IS HEREBY ORDERED THAT: <br /> 1. The portion of Scobert Park, located at 1180 West 4 Avenue, delineated by a <br /> black wrought iron fence erected by the City, is hereby closed to entry by all persons other than <br /> police officers, authorized City employees and persons with written authorization from the <br /> Public Works Director or the Parks Maintenance Manager, effective 12:01 a.m., April 23, 2010. <br /> The closure shall remain in effect until April 22, 2012. <br /> 2. In addition to any other measures that may be implemented to ensure that entry to <br /> the closed portion of Scobert Park is restricted, the City shall maintain fences or other barriers <br /> around the closed area and shall post clearly visible signs at such locations as deemed <br /> appropriate, advising the public that, pursuant to this Administrative Order No. 58- 10 -04, entry <br /> into the fenced area is prohibited and any unauthorized person entering or remaining within the <br /> Administrative Order - Page 1 of 2 <br />
