DRAFT <br /> MEMORANDUM OF AGREEMENT <br /> for the <br /> DEDICATION OF PUBLIC OPEN SPACE <br /> BETWEEN: Lee Lynn, Inc. and Wiley Mt., Inc. (OWNERS) <br /> AND The City of Eugene Parks & Open Space Division (PARKS) <br /> RECITALS <br /> A. The OWNERS own approximately 197 acres of real property in the north Santa Clara <br /> area. The property is entirely located inside the Urban Reserve but outside of the current <br /> Urban Growth Boundary. A map of this property is depicted in Exhibit A (attached). <br /> B. The OWNERS also own real property in the Laurel Hill Valley. Of this, approximately <br /> 120 acres are within the current Urban Growth Boundary. A map of this property is <br /> depicted in Exhibit B (attached). <br /> C. The OWNERS previously made written request to City staff to remove the Laurel Hill <br /> Valley acreage from the Urban Growth Boundary and replace it with an equal amount of <br /> the Santa Clara acreage. <br /> D. PARKS desires property in the Santa Clara area for use as a community park. <br /> Approximately 40 to 100 acres is desired for the park, with a minimum of 40 acres that is <br /> able to be fully developed for active recreation facilities, such as ballfields, children's <br /> play areas, restrooms, picnic facilities, basketball and tennis courts, and a future <br /> community center. This community park is identified as a need in the Eugene Park and <br /> Recreation Plan, adopted by the Eugene City Council in 1989, and was included in the <br /> 1998 Parks & Open Space bond measure. <br /> E. PARKS has reviewed available land in the Santa Clara area. No undeveloped or <br /> underdeveloped property of adequate size for a community park exists within the existing <br /> Urban Growth Boundary. <br /> FE. In order to provide a community park at current City standards to residents of Santa <br /> Clara, PARKS desires to annex property into the Urban Growth Boundary.
