LEASE WITHIN ALTON BAKER PARK " 3-0531 LESSOR: The City of Eugene, an Oregon municipal corporation ( "City") LESSEE: Emerald Valley BMX, an Oregon nonprofit corporation ( "Emerald Valley ") DATE: September 23, 2002 In Laserfiche RECITALS City owns land referred to as Alton Baker Park located within Lane County, Oregon. Emerald Valley has developed and operated a bicycle motocross facility on certain land within Alton Baker Park as permitted by City. Emerald Valley has previously leased from City the land that is the subject of this lease (the "Premises "). The prior lease expired on June 3, 2002. Emerald Valley wishes to continue to lease the Premises from City. Emerald Valley is a member in good standing with the American Bicycle Association. City has determined that a lease between City and Emerald Valley is in the best interest of the public. The purpose of this agreement is to confer to Emerald Valley a leasehold interest in the Premises to provide an activity for youth of the community in the form of a sport known as BMX (bicycle motocross) and for no other purpose except other bicycle - related activities. AGREEMENT The parties therefore agree as follows: Section 1. -Agreement to Lease. City hereby leases to Emerald Valley and Emerald Valley hereby leases from City, on the terms and conditions set forth below, the following described Premises: Beginning at the Northwest Corner of Section 33, Township 17 South, Range 3 West of the Willamette Meridian; thence running along the south line of that certain survey by Steven E. Ford filed in the Lane County Surveyor's Office as County Survey File No. 14629, South 87050'15" East 71.16 feet; thence South 87050'15" East 103.84 feet to the true point of beginning; thence leaving said survey and running South 2001'45" West 347.00 feet; thence South 87 Lease - Page 1
