In the spring of 2004, the issue was reviewed by EVB legal counsel and they concluded <br /> that a case could be filed against the Snooks, but the board decided not to pursue the costly <br /> litigation. EVB's legal counsel agreed with the majority of the Department's previous findings, <br /> including that there is no verifiable audit trail with regards to the parking income. However, <br /> their legal counsel disagreed with the finding that there was insufficient evidence to reach a firm <br /> conclusion on parking revenue figures. The letter from EVB's legal counsel failed to expand this <br /> issue and explain how parking revenue could be calculated. The EVB board decided to cease all <br /> legal action against the Snooks and refocus on racing <br /> With the information from the EVB legal counsel review, stating that parking revenue <br /> has increased since Mr. Snook resigned. It was decided that the Department would reopen the <br /> investigation and specifically address the discrepancy in parking revenue. <br /> PARKING REVENUE INVESTIGATION <br /> Investigators began an exhaustive attempt to document parking revenue from 1996 to <br /> 2002 by reviewing bank statements and deposit slips, inspectin, the parking lot, and <br /> interviewing EVB members, including Scott and Candy Snook'. Again, we found the records <br /> incomplete and extremely difficult to audit. University of Oregon football game schedules did <br /> not match to noted parking revenue deposits dates, concluding that deposits were not on a regular <br /> basis. Through frequent conversations with the original complainant and an interview with Mr. <br /> Snook, it was revealed that Mr. Snook often employed Alvis "Duane" Taylor to manage the <br /> parking lot during football games. It is believed that Mr. Taylor received a 60/40 split of parking <br /> revenue but this undocumented arrangement, made by Mr. Snook, further dilutes a concrete <br /> figure of parking revenue for a particular football game. We have been told that parking revenue <br /> was strictly dealt in cash, which eliminates any audit trail to follow. <br /> Attempts to contact Mr. Taylor were unsuccessful. Mr. Taylor's family was contacted <br /> and they stated that he is recently divorced and does not have a stable residence. They promised <br /> to relay a message to him that Department investigators wanted to speak with him but he has <br /> never contacted this office. Mr. Taylor's criminal background check revealed multiple arrests <br /> for assault, drug use, hit and run, reckless driving and a felony charge of driving with a <br /> suspended driver's license. Without any documentation or testimony from Mr. Taylor, it is <br /> unknown if he collected 100% of the parking revenue and submitted to Mr. Snook or Mr. Taylor <br /> took his percentage directly and submitted the remainder to Mr. Snook. Excluding the details of <br /> the arrangement, it is also possible that Mr. Taylor initially diverted cash and did not submit <br /> accurate parking revenue to Mr. Snook <br /> 2 See letter from Emerald Valley BMX, dated April 5, 2004. The board's position was again restated during a <br /> meeting with President Lance Maguire on April 21, 2005 who said that the board has put this issue behind them and <br /> wants to focus solely on racing. Mr. Maguire said that the EVB board has new parents and few even remember <br /> Scott Snook. Mr. Maguire also said "you can not squeeze blood from a turnip."
