We are aware that Scott continues to suffer from declining health and have <br /> heard those issues make continued employment within his field of expertise more difficult for him, <br /> and we are truly saddened. We would prefer not to add additional stresses to your lives during your <br /> difficult times and have taken these issues into consideration while deciding on this resolution offer to you. <br /> Please understand that the case file at the Department of Justice on Emerald Valley BMX is not closed. <br /> Our Executive Board is bound by law to a fiduciary responsibility and must take action that is in our <br /> organizations best interests. To fulfill our responsibilities as an organization, we are required to resolve our <br /> discrepancies with you and report the outcome to the Department of Justice so that the case file may be <br /> closed. We must act under the prerequisite that our offer of settlement to both of you is in the best interests <br /> of Emerald Valley BMX, is principled, and consistent with the advice of our legal counsel. Therefore, our <br /> preferred option as this time is to resolve our disputes directly with you and try to avoid expensive legal <br /> actions.
