• n v <br /> o <br /> INTERGOVERNMENTAL AGREEMENT (-' <br /> THIS AGREEMENT entered into by and between LANE COUNTY, a j, <br /> political subdivision of the State of Oregon, hereinafter referred glom <br /> to as COUNTY, and the CITY OF EUGENE, a municipal corporation, <br /> hereinafter referred to as CITY. <br /> V � <br /> RECITALS ° a <br /> c7 <br /> N C <br /> A. ORS 190.010 and the Lane County Home Rule Charter pro- <br /> vide that units of local government may enter into agreements for --r <br /> the performance of any or all functions and activities that a 2 n <br /> party to the agreements, its officers or agents, have authority to <br /> perform. <br /> B. COUNTY and CITY recognize a need to increase efficien- N <br /> cies in public service delivery mechanisms in the Eugene /Spring- <br /> field metropolitan area due to the decrease in resources available <br /> for public services and facilities. <br /> C. COUNTY and CITY have determined that responsibility for <br /> the delivery of certain services occurring in the metropolitan <br /> area could appropriately be transferred from COUNTY to CITY. <br /> D. COUNTY is the owner of park properties within the metro- <br /> politan area, more fully described in Exhibit "A" attached hereto. <br /> E. It would be in the best interest of both parties for <br /> COUNTY to convey its ownership in said properties to CITY. <br /> F. COUNTY also is owner of Alton Baker Park, more fully <br /> described in Exhibit "B" attached hereto. <br /> G. It would be in the best interest of both parties for <br /> COUNTY to convey its ownership in the western portion of Alton <br /> Baker Park, more fully described in Exhibit "C" attached hereto, <br /> to CITY. - <br /> H. It would be in the best interest of both parties to have <br /> CITY operate and manage the remaining portions of Alton Baker <br /> Park, more fully described in Exhibit "D" attached hereto, for a <br /> period of time sufficient to allow COUNTY to assess the feasibil- <br /> ity and desirability of developing a golf course in that portion <br /> of the park. <br /> AGREEMENTS <br /> In consideration of the mutual agreement of the parties <br /> hereto, the parties hereby agree as follows: <br /> A. Transfer of COUNTY Park Properties to CITY. <br /> 1. COUNTY agrees to convey ownership of park prop- <br /> erties described in Exhibits "A" and "C" to CITY as soon as con- <br /> - Intergovernmental Agreement <br /> (Lane County /City of Eugene) - 1 <br /> Exhibit A to contract #98 -328 <br />
