Special District White Paper — Draft for Internal Review <br /> governments worked cooperatively to develop a regional solution, and financing, operation, and <br /> responsibility of the regional facility is shared. <br /> DISTRICT FORMATION AND ANNEXATIONS <br /> The Lane County Local Government Boundary Commission has jurisdiction over boundaries of <br /> park and recreation districts; county service districts, library districts and rural fire <br /> protection districts, among others, within Lane County (Appendix E lists all the types of districts <br /> that are subject to the Boundary Commission). However, the boundary commission does not <br /> have jurisdiction over port districts or county road districts; the county board has jurisdiction <br /> over these types of districts instead. <br /> For special districts under the Boundary Commission's jurisdiction, ORS Chapter 199 governs <br /> Major Boundary Changes and Minor Boundary Changes. Major changes include district <br /> formation, merger, consolidation dissolution, while minor changes include annexation, <br /> withdrawal or transfer of territory (See Appendix D for definitions of these terms). Since the Commission is a state agency, its decisions are not subject to <br /> a referendum. <br /> Requirements for District Formation <br /> District formation processes are most often initiated by petition by electors as provided in ORS <br /> Chapter 198. ORS Chapter 199 thereafter governs the process for districts under the under the <br /> Boundary Commission's jurisdiction. <br /> Outline of Formation Process <br /> • Before circulating a petition for formation of a district, the petitioners must file with the <br /> county clerk a prospective petition. <br /> • Boundaries must be described in the prospective petition. <br /> • Territory within an existing special district may not be included within another new district <br /> subject to the same principal Act. <br /> • Before circulating the petition, the petitioners must complete an economic feasibility <br /> statement. This statement shall form the basis of the proposed permanent rate limit for <br /> operating taxes. It must include: <br /> 1. A description of services and functions to be performed; <br /> 2.
