Special District White Paper
This intergovernmental relationship between a county service district and an intergovernmental
body has worked well in the metropolitan area. A needed service was identified, the local
governments worked cooperatively to develop a regional solution, and financing, operation, and
responsibility of the regional facility is shared.
DISTRICT FORMATION AND ANNEXATIONS
The Lane County Local Government Boundary Commission has jurisdiction over boundaries of
park and recreation districts, county service districts, library districts and rural fire protection
districts, among others, within Lane County (Appendix E lists all the types of districts that are
subject to the Boundary Commission). However, the Boundary Commission does not have
jurisdiction over port districts or county road districts; the Lane County Board of Commissioners
has jurisdiction over these types of districts instead.
For special districts under the Boundary Commission's jurisdiction, ORS Chapter 199 governs
Major Boundary Changes and Minor Boundary Changes. Major changes include district formation,
merger, consolidation dissolution, while minor changes include annexation, withdrawal or transfer of
territory (see Appendix D for definitions of these terms). For county road districts and port districts,
only ORS Chapter 198 applies, while Chapter 199 does not apply. The terms major and minor
boundary changes are not used in Chapter 198, but the processes of formation and annexation are
addressed.
41, In the 32 years since its creation in 1969, only three proposals have been submitted for the
formation of new governments in the Eugene - Springfield metropolitan area. Of these the Boundary
Commission has approved only one, the Lane County Metropolitan Wastewater Service District, a
county service district initiated by the County Board of Commissioners.
The Boundary Commission may approve a proposal, modify the proposed boundary only, or may
disapprove a proposal. Since the Commission is a state agency, its decisions are not subject to a
referendum.
Requirements for District Formation
District formation processes are most often initiated by petition by electors as provided in ORS
Chapter 198. ORS Chapter 199 thereafter governs the process for districts under the under the
Boundary Commission's jurisdiction.
Outline of Formation Process
• Before circulating a petition for formation of a district, the petitioners must file with the county
clerk a prospective petition.
• The proposed boundary must be described in the prospective petition.
• Territory within an existing special district may not be included within another new district
subject to the same principal Act.
• Before circulating the petition, the petitioners must complete an economic feasibility
statement. This statement shall form the basis of the proposed permanent rate limit for
c o, operating taxes. It must include:
Special Districts Paper - Final 11- 8- 01.doc Page 19 of 41
City Council Agenda page 43
