Special District White Paper <br /> receives services from a district and is part of that district, the State statutes provide <br /> When a city rece P <br /> that any territory thereafter annexed to the city shall be included within the boundary of the district. <br /> On the other hand, if a city within Lane County is not already part of a special district, the statutes <br /> require that annexation to a city of territory served by the district results in an automatic withdrawal <br /> of the territory from the district. <br /> SPECIAL DISTRICTS AND METROPOLITAN PLANS <br /> Current Metropolitan Plan Policies <br /> The Eugene - Springfield Metropolitan Area General Plan (Metro Plan) policies control the formation <br /> of special districts within the jurisdictional boundary of the plan, so it is important to understand the <br /> relevant policy requirements. Generally, the existing plan views special districts as interim solutions <br /> for provision of services to urban transition areas prior to annexation by a city. <br /> The jurisdictional boundary of the Metro Plan extends beyond the urban growth boundary and <br /> includes three general - purpose govemments: the cities of Eugene and Springfield and Lane <br /> County. Any proposed new special district or annexation to an existing district within the area of the <br /> Metro Plan must be consistent with the plan. Currently, the Metro Plan contains the following <br /> policies: <br /> Policy #14 states: "Creation of new service districts or zones of benefit within the jurisdictional <br /> Lie boundary of the Metro Plan shall be considered only when all of the following criteria are <br /> satisfied: <br /> • There is no other method of delivering public services that are required to mitigate <br /> against extreme health hazard or public safety conditions. <br /> • The three metropolitan area general - purpose governments concur with the proposal to <br /> form the service district or zone of benefit. <br /> • The district or zone of benefit is an interim service delivery method, and there are legal <br /> assurances, such as annexation agreements, to ensure that annexation to the <br /> appropriate city occurs within the planning period. <br /> • The serving city is not capable of providing the full range of urban services in the short <br /> term although it is recognized that urban services will be provided by a city consistent <br /> with adopted public facilities plans and capital improvement programs. <br /> • The district or zone of benefit will contract with the appropriate city for interim service <br /> delivery until annexation to the city. <br /> Policy #18 promotes merger or consolidation of fringe special service districts. <br /> Policy #19 establishes controls on annexation of territory to existing special districts within the <br /> urban growth boundary. <br /> Policy #20 establishes the priority order for providing any new urban service within the urban <br /> growth boundary: (1) annexation to a city, (2) contractual annexation agreement with a city, (3) <br /> annexation to an existing district, and (4) creation of a new service district (with reference to #14 <br /> above). <br /> c <br /> Special Districts Paper - Final 11- 8- 01.doc Page 7 of 41 <br /> City Council Agenda page 31 <br />
