• <br /> State of Oregon / City of Eugene / EWEB Page 2 <br /> Local Agency Agreement #15, 017 <br /> 10/28/97 <br /> b) Construct the bicycle path to a standard capable of supporting EWEB's <br /> maintenance vehicles without pavement damage. <br /> c) Have all construction work accomplished in a neat and orderly manner, grading <br /> work areas to restore existing conditions as much as possible. <br /> 2. State shall, after the completion of the project and at its own expense, maintain the <br /> slopes and do so in such a manner as to not endanger EWEB's facilities. <br /> 3. State shall, after the completion of the project and at its own expense, maintain the <br /> structural integrity of the soundwall. <br /> 4. State shall submit the project's illumination plan for review by EWEB to assure <br /> adequate clearance between illumination poles and EWEB's power line is maintained. <br /> 5. State shall allow EWEB to excavate in highway slopes within EWEB right -of -way to <br /> install or maintain a water line or other underground utility. Where EWEB right -of -way <br /> is not sufficiently wide to construct utilities without minor, incidental excavation on State <br /> right -of -way, State may allow EWEB to perform such excavation. The permission to <br /> perform the excavation will be subject to the provisions of a permit issued by State. <br /> 6. State shall have initial landscaping placed as shown on construction plans. State shall <br /> obtain EWEB approval before placing any landscaping on EWEB property in <br /> connection with the construction project. <br /> 7. State shall provide City with construction plans showing the specifications for the <br /> bicycle path construction. <br /> CITY OBLIGATIONS <br /> 1. City shall, after completion of the project and at its own expense, maintain the bicycle <br /> path, including mowing the vegetation immediately adjacent to the bicycle path, and <br /> any landscaping placed on EWEB's property in association with the bicycle path. <br /> 2. City will allow EWEB to have access onto the bicycle path for maintenance or <br /> construction of EWEB's utilities. <br /> 3. City shall, at its own expense, repair damage to the bicycle path resulting from EWEB's <br /> installation and maintenance of EWEB's facilities, should damage occur. <br />
