INTERGOVERNMENTAL AGREEMENT <br /> THIS AGREEMENT entered into by and between LANE COUNTY, a political subdivision of the State <br /> of Oregon, hereinafter referred to as COUNTY, and the CITY OF EUGENE, a municipal corporation, <br /> hereinafter referred to as CITY. <br /> RECITALS <br /> A. ORS 190.010 and the Lane County Home Rule Charter provide that units of local <br /> government may enter into agreements for the performance of any or all functions and <br /> activities that a party to the agreements, its officers or agents, have authority to perform. <br /> B. COUNTY and CITY recognize a need to meet requirements to safeguard public welfare and <br /> to increase efficiencies in public facility maintenance within the Eugene metropolitan area. <br /> C. COUNTY and CITY agreed to identify as needed streets to be surrendered to CITY, either <br /> because of annexation or oversight of previous annexations. <br /> D. COUNTY and CITY have identified streets, shown in Exhibit "A ", which had not been <br /> previously requested for surrender to the CITY by the COUNTY. It is expected these streets <br /> are to be surrendered prior to the expiration of this agreement. <br /> E. COUNTY and CITY have determined that the public interest is served by transferring to CITY <br /> all operational maintenance responsibility over these roads to be surrendered, except as <br /> modified by this agreement. <br /> AGREEMENTS <br /> In consideration of the mutual agreement of the parties hereto, the parties hereby agree as follows: <br /> 1. For the purpose of this agreement, CITY and COUNTY have defined operational maintenance as <br /> any shoulder and surface maintenance, drainage maintenance, roadside vegetation control, <br /> bridge and structure maintenance, snow and ice control, guard rails, facility permit issuance <br /> and enforcement, maintenance of markings, signing, operations and maintenance of traffic <br /> signals, and, unless otherwise specified. <br /> 4 <br /> 2. CITY will request surrender of all roads and structures listed in Exhibit "A" prior to the <br /> expiration of this agreement. <br /> 3. Effective 12:01 a.m. January 1, 2005, CITY agrees to provide operational maintenance upon all <br /> roads and structures listed in Exhibit "A ", except as specified otherwise in this agreement. <br /> Intergovernmental Agreement — Operational Maintenance <br /> City of Eugene /Lane County - Page 1 <br />
