Public Notice <br /> Amy Permit Conditions <br /> us Army corps <br /> of Engineers <br /> Portland District <br /> -- September 29, 1993 <br /> On November 12, 1991, the U.S. Army Corps of Engineers published in the Federal Register at 33 <br /> CFR 330, Appendix A, the final rule of its nationwide permit regulatory program. That regulation <br /> authorized certain minor activities in waters of the United States provided the proposed work meets the <br /> terms and conditions of the particular nationwide permit and in certain circumstances is granted water <br /> quality certification from either Oregon Department of Environmental Quality (DEQ) or U.S. <br /> Environmental Protection Agency (EPA) and is found consistent with the Oregon Coastal Management <br /> Program by Oregon Department of Land Conservation and Development (DLCD). A public notice <br /> listing the terms and conditions was published February 14, 1992, and is attached for informational <br /> purposes. <br /> When nationwide permits 6, 7, 12, 14, 16, 17, 21, 22, 23, 26, 33, 34, 36, and 40 were initially <br /> announced in the public notice of February 14, 1992, water quality certification for each activity, on a <br /> case by case basis, was required from DEQ when fill or dredged material was placed in waters of the <br /> United States. Recently, however, DEQ has specified certain limits and conditions underwhich four <br /> nationwide permits are granted water quality certification. The purpose of this public notice is to <br /> inform the public of those conditions and limitations. For nationwide permits 12, 14, 33, and 36, if <br /> the work conforms to the limits and conditions specified below, water quality certification is <br /> considered granted. <br /> Nationwide Permit 12, Utility Lines. <br /> Water Quality certification has been granted by Oregon Department of Environmental Quality for <br /> Nationwide Permit 12 provided the fill volume within waters of the United States does not exceed 500 <br /> cubic yards or occur in an estuary, subject to the following conditions: <br /> Condition 1. All in -water work, including temporary fills, shall occur within the Oregon Department <br /> of Fish and Wildlife preferred work period. (See attached OREGON GUIDELINES FOR TINTING OF <br /> IN-WATER WORK TO PROTECT FISH AND WILDLIFE RESOURCES, dated November 1991.) <br /> Condition 2. Turbidity shall not exceed 10% above natural stream levels, and in no case shall the <br /> turbidity increase adversely affect an identified beneficial use as defined in OAR 340 -41. The turbidity <br /> standard may be exceeded for limited duration, provided all practicable erosion control measures are <br /> implemented, including: <br /> a) use of filter bags, sediment fences, leave strips or berms, or other measures sufficient to prevent <br /> offsite movement of soil, <br /> b) use of impervious material to cover stockpiles when left unattended or during storm events, <br />
